All Wills need to comply with the Wills Act 1837. As previously mentioned, there are a number of reasons why there are grounds for contesting a Will. Other stipulations are that it must be in writing and signed by the testator (the person who makes the Will).
Some of the reasons a Will could be challenged are:
- On the basis that the Will instructions were given when the person did not have the mental capacity
- The Will was fraudulently written by somebody else claiming to be you
- Undue influence, i.e. forcing you to make a provision when you do not want to
- Not complying with the Wills Act 1837 in the way the Will was written
