Guardianship should be appointed within a WILL by the child’s parents.
Many people are misinformed that in the event of the death of both parents a child would be automatically taken care of by a family member or friend, arrangements of which may have been informally discussed. However, unless these wishes are documented in a Will this will not be the case and your children may temporarily be taken into care.
In fact a friend or family member who wanted Guardianship would have to go through the lengthy fostering and/or adoption process in order to become a Legal Guardian.
It is essential and easy to avoid this unnecessary and distressing process by simply nominating Guardians within your WILL.
